Conditions of use

We publish our program most way as free- or shareware. Here are the conditions of use for this kind of software:

Freeware

• Payment/costs
• All rights remain to Cool Engineering. Only a license for usage is granted.
• Cool Engineering don't want a payment for the program. The use of the program is free.
• Cool Engineering reserves the right to charge a fee for future, more functionally versions of the program.
• Once a version (see V-number) is declared as freeware, this status will kept and it will be free forever.

• Distribution
• You are allowed to copy the program and give it to other. This includes the publishing on shareware-CDs/DVDs or as supplement in print media (specimen copy would be nice) and also the sharing via internet. Of course the exchange between individuals (by copy, P2P etc.) is allowed too.
• By adding the program to an online-dictionary a link to the corresponding webpage(s) of Cool Engineering should be placed to give the internet user the possibility to receive the newest informations about the program.
• The in previous points given abstract sharing right can be revoked anytime for individuals, groups or companies if Cool Engineering sees its interests affected.
• The program has to given away only in the way it is, completely and unchanged.
• To offer the program with other programs in one package (regarding the interoperability; a package like made in a shareware collection is not meant) requires the permission of Cool Engineering. It is strictly forbidden to offer the program with other programs or information, on the same or a neighbor or however made available source, that stands in conflict with the interests of Cool Engineering, such as cracks, patches, loader, diassembling listing etc.
• It is forbidden to take a charge for the program in such a amount, that it seems to be unfair in the opinion of Cool Engineering or the end user without the permission of Cool Engineering. (This does normally not apply for supplements to print publications that are offered to standard prices and for that the editorial part stands in foreground)

• Responsibility/warranty
• Cool Engineering is in no kind reponsible for any kinds of damage on your computer, your software or something else, which may occurs by using the program.

• Other conditions
• Changes or manipulations to the program on permanent (HDD etc.) or non-permanent (RAM) memory including hex-editing, memory patching and reverse engineering by decompiling, deassembling, debugging, tracing, scanning or other techniques are strictly forbidden. You have to use the program that way it is written for, no abuse is allowed.
• The source code, algorithms and techniques used in programs of Cool Engineering are confidential business secrets. It is strictly forbidden to try to uncover these secrets (e. g. by using reverse engineering tools or techniques). If such a secret comes to your knowledge by accident you are obligated to secrecy. The publication of such secrets or the creation of a possibility to override a mechanism is strictly forbidden and will be prosecuted.
• The ex-/import of the program has to comply to the conditions of the corresponding country. This especially applies to programs with strong cryptographic algorithm.
• Legal basis is the right of the Federal Republic of Germany.

Shareware

• Payment/costs/unlocking
• All rights remain to Cool Engineering. Only a license for usage is granted.
• The program isn't free of charge, a fee falls due for using the program.
• The program can be tested for a first period.
• The shareware-version (that after download) of the program normally has limitations in functionality or can only be used a specified time with all functions.
• In case of no limitations of the program the using is only licence-free as the program is only used sometimes and the total period of using does not exceed 30 days.
• By buying and registration the programm the user gets the right of using the program (licence) in full functionality. With the licence the user receives a key to unlock the program, so he can use the program without limitations.
• A purchased licence only is valid for the version of the unlocked program, not self-evident for all future releases.
• The licence-conditions, informations about the unlocking process and fees can be found in the program or at the website of Cool Engineering.

• Distribution
• You are allowed to copy the shareware-version of the program and give it to other. This includes the publishing on shareware-CDs/DVDs or as supplement in print media (specimen copy would be nice) and also the sharing via internet. Of course the exchange between individuals (by copy, P2P etc.) is allowed too.
• By adding the program to an online-dictionary a link to the corresponding webpage(s) of Cool Engineering should be placed to give the internet user the possibility to receive the newest informations about the program.

• It is forbidden to take a charge for the program in such a amount, that it seems to be unfair in the opinion of Cool Engineering or the end user without the permission of Cool Engineering. (This does normally not apply for supplements to print publications that are offered to standard prices and for that the editorial part stands in foreground)
• It is prohibited to give away the unlocked version of the program or the unlock-key to anyone else. Keys, that becomes public, will be blocked and becomes invalid.
• The program can't used any further with a blocked key. Legal users with a valid licence has to write to the support to get a new one.

• Responsibility/warranty
• No responsibility is given for the shareware-version of the program.
• For the purchased program a limited liability amounting to the payed fee is given, any responsibility about this amount is excluded.
• A responsibility for the loss of use of the programm caused by a blocked key is excluded.
• A responsibility for damages caused by viruses or something else that kind is excluded.
• A responsibility/warranty is only given for the use of the program under the described system-environment. No repay of fees will be made only because the user hasn't the right system-environment.
• In case of errors in the program, the right of Cool Engineering to correct the error in a new release is higher ordered than the right of the user of getting back his fee.

• Other conditions

• All rights remain to Cool Engineering. Only a license for usage is granted.
• The program isn't free of charge, a fee falls due for using the program.
• Before paying the using fee (e. g. by buying) it isn't allowed to use the program.
• A purchased licence only is valid for the bought version of the program, not self-evident for all future releases.
• The licence is valid, if not concerted different, for using the program on one computer.
• Possibly the program has to been unlocked before using or in the first time of using.

• Distribution
• Commercial products will be distributed by Oliver Kuhlemann or by authorized traders in the form of original packaged media.
• It is prohibited to copy or spread commercial products.
• It is forbidden to lend the product to others.

• Responsibility/warranty
• A limited liability amounting to the payed fee is given, any responsibility about this amount is excluded.
• A responsibility for the loss of use of the programm is excluded.
• A responsibility for damages caused by viruses or something else that kind is excluded.
• A responsibility/warranty is only given for the use of the program under the described system-environment. No repay of fees will be made only because the user hasn't the right system-environment.

• Legal basis is the right of the Federal Republic of Germany.
• Possibly other to the product enclosed licence conditions take effect.

Demo

• Payment/costs
• All rights remain to Cool Engineering. Only a license for usage is granted.
• A demo is a limited preview version of a commercial product.
• The demo version itself is free of charge.

• Distribution
• You are allowed to copy the demo and give it to other. This includes the publishing on shareware-CDs/DVDs or as supplement in print media (specimen copy would be nice) and also the sharing via internet. Of course the exchange between individuals (by copy, P2P etc.) is allowed too.

• Definition
• Beta versions are programs at later development levels but not for public use in this stage.
• Beta versions are programs with a version number between 0.900 and 0.999.

• Distribution
• Beta versions are only given to authorized beta testers by Oliver Kuhlemann itself.
• It is forbidden to copy, give away or spread a beta version without the permission of Cool Engineering.

• Responsibility/warranty
• Cool Engineering is in no kind reponsible for any kinds of damage on your computer, your software or something else, which may occurs by using the program.

• Other conditions
• Changes or manipulations to the program on permanent (HDD etc.) or non-permanent (RAM) memory including hex-editing, memory patching and reverse engineering by decompiling, deassembling, debugging, tracing, scanning or other techniques are strictly forbidden. You have to use the program that way it is written for, no abuse is allowed.
• The source code, algorithms and techniques used in programs of Cool Engineering are confidential business secrets. It is strictly forbidden to try to uncover these secrets (e. g. by using reverse engineering tools or techniques). If such a secret comes to your knowledge by accident you are obligated to secrecy. The publication of such secrets or the creation of a possibility to override a mechanism is strictly forbidden and will be prosecuted. Beta-testers bear responsibility and care in a high amount because of the extended mutual trust that's given to them.
• The ex-/import of the program has to comply to the conditions of the corresponding country. This especially applies to programs with strong cryptographic algorithm.
• Legal basis is the right of the Federal Republic of Germany.

Alpha version

• Definition
• Alpha versions are programs at early development level and not for use outside of Cool Engineering.
• Alpha versions are programs with a version number lower than 0.900.

• Distribution
• Alpha versions are only for further development by Oliver Kuhlemann.
• It is forbidden to use, copy, give away or spread an alpha version.

• Responsibility/warranty
• Cool Engineering is in no kind reponsible for any kinds of damage on your computer, your software or something else, which may occurs by using the program.

• Other conditions
• The source code, algorithms and techniques used in programs of Cool Engineering are confidential business secrets. It is strictly forbidden to try to uncover these secrets (e. g. by using reverse engineering tools or techniques). If such a secret comes to your knowledge by accident you are obligated to secrecy. The publication of such secrets or the creation of a possibility to override a mechanism is strictly forbidden and will be prosecuted. The pure possession of an alpha version is already a violation of the confidentiality and have to be announced to Cool Engineering immediately.
